The Philips Respironics European Class Action represents thousands of users exposed to toxic medical devices. Many of them reporting health issues from device use.
By end of 2024 the recall initiated in 2021 (after many years of hiding the defects) has not been completed.

The "Philips Respironics European Class Action" project was created to protect the rights of users exposed to various toxic substances produced by certain medical devices.


The recall is still ongoing despite more than 3 years have passed.


A few weeks before the first class action hearing in Milan, scheduled for December 19, 2024, we are sharing some statistics about who has registered on cpapauerope-classaction.com.


According to those who completed the questionnaire, 50% of users state that they have not received a recall letter or an official recall communication for the devices.


Among all participants, more than 50% of people declare suffering from a condition they believe was caused by the use of the medical devices in question. This percentage is comparable to what has recently been observed in non-EU jurisdictions.



The countries from which we have received the most class action registrations are, in addition to Italy, Belgium, Germany, Spain, France, and Great Britain, but citizens from Northern and Eastern Europe are also submitting their cases.



Regarding those who claim to have a condition related to the use of medical devices, the continuous average usage is 6 years. In other words, considering an average use of 7 hours every night, this results in a total of more than 15,000 hours of average device usage.

Among the recalled models, 53% are DreamStation CPAP users, 10% System One 60 series, and a smaller percentage for other models.



Finally, the age distribution of people with conditions shows a higher incidence for those over 40 years old and a smaller, but not negligible, presence of patients between 20 and 40 years old.
