Clients who register on the CPAP Europe website enter a preliminary assessment phase for the class action. Formal inclusion in the case will depend on the Milan court’s ruling of admissibility. We are pleased to provide you more information regarding the process described on the CPAP Europe website.

On June 2024 a European – wide class action was filed in the Milan Court in the interest of all claimants from the EU affected by the Philips-Respironics devices. As it is described in this website, a coalition made by many claimants, lawyers and several entities from several jurisdictions of the EU took such action to have their rights recognized and damages compensated. They believe they have provided the Court with all elements giving rise to a class of users with homogeneous rights and they believe, also, that they are well suited and organized to represent and manage this complex scenario to a positive conclusion in the interest of all victims, regardless of the country they may live or the language they may speak.


At the end of the day, the devices are equal, as equal are the quality problem and the injuries and damages faced by users.

The legal process is run by Italian procedure and it has certain steps: after the filing of our complaint, this was served in Milan, Pennsylvania, Delaware, Germany and the Netherlands within the term indicated by the Milan Court.

By signing up and “joining the action” through our online form, you/individuals are taking the initial step to submit your case to the plaintiff’s team for evaluation purposes.

Such evaluation is based on several matters which are partly screened through the format you are being requested to complete.

Whenever an injury is indicated by you as being (or thought to be) caused by the use of the Philips devices, the evaluation then goes on privately through our team of experts who give an initial opinion on such causal relationship.

The gathering of information through the website has the additional added value of allowing epidemiological and statistical analysis: it is a shocking reality that many of you, in a percentage that is over 60% of those who submitted their cases, so far believe they are suffering an injury and they believe it was caused by using the Philips devices.

A high percentage of such submissions highlights injuries that in the USA would be considered as “qualifying injuries” in the context of the settlement that Philips reached with the plaintiffs in the analogous class action pending there.


Italian laws give considerable value to the act of filing of a class action and this has many positive and protective ramifications in the interest of the claimants’ rights.

While we are gathering such information to assess each situation, we wish you to be informed that under Italian law, formal adherence to the class action for all of you (i.e. Mr. Hans W., or Mrs. Francoise D., and so on) will be possible once the Milan court officially declares the class action admissible, or even after that moment. According to Italian law, even after a positive decision!
